Participation policy and Agreement
Comic Con Seoul 2020 Booth Participation Policy Article 1 Definitions of Terms 1. “Exhibitor (Participating Company/Artist)” refers to the company, association, entity, or individual submitting the application for participation in the exhibition. 2. “Exhibition” refers to Comic Con Seoul 2020. 3. “Organizer” refers to Reed Exhibitions Korea and Comic Con Seoul 2020 Office. Article 2 Contract, Application, Participation Fee Payment Procedure 1. Application (contract) must be submitted to the Comic Con Seoul 2020 Office. 2. Payment should be completed in following schedule. 2-1. Corporate Booth : Payment for the deposit(50% of total booth participation fee, VAT included) should be completed within 15 days of submission. The balance(50% of total booth participation fee + utility fee, VAT included) should be paid by June 30, 2020. 2-2. Artist Alley : Payment for the contract should be completed within 15 days of submission. (Refer to guideline on participation) 3. The participation fee covers the costs for the venue, 24 hour security, hallway cleaning, provision of PR data, exhibition directory, and provision of other information until the opening of the exhibition. Article 2 Allotment of Exhibition Space 1. Based on the order of down payment, scale of participation, whether a returning participant, composition of the exhibition, and nature of exhibited products, the organizer allocates space to the participating companies within the exhibition hall. 2. On special occasions, the organizer may change the space allocated to the exhibitors as long as it is before the preparation period. Such changes are under the discretion of the organizer, and exhibitors cannot request compensation thereof. Article 4 Exhibit Limits & Hall Management 1. Exhibitors must display stated exhibits, and locate permanent staff in the booths. 2. Activities of exhibitors are limited within the allocated space. 3. Exhibitors may not assign all or part of the already allocated exhibition area to a third party without the approval of the organizer. 4. The responsibility of loss, damage, robbery, and all other related matters regarding the exhibits resides with the exhibitors (participating companies). 5. The organizer may limit harmful actions to other exhibitors, excessive noise, and divided use of the same booth with other companies, and exhibits disagreeing with the nature of the exhibition. Article 5 Cancellation 1. In events that the exhibitors decline to use the space allocated, fail to pay the participation fee or fail to comply with the regulations set by the organizer, the organizer can void application and the participation fee will not be refunded. 2. In events that an exhibitor decides to downgrade or cancel the floor space applied for, the following penalty needs to be paid to the organizer within 15 days of cancellation. If the exhibitor has already paid the registration fee in full, the penalty will be deducted from it. 2-1. Corporate Booth : - Cancellation or Reduction of number of booth until April 30, 2020: 50% of total participation fee - Cancellation or Reduction of number of booth from May 1, 2020 ~ June 30, 2020: 80% of total participation fee - Cancellation or Reduction of number of booth after July 1, 2020: 100% of total participation fee 2-2. Artist Alley : - Cancellation or Reduction of number of booth until April 30, 2020: 50% of total participation fee - Cancellation or Reduction of number of booth after May 1, 2020: 100% of total participation fee Article 6 Act of God The organizer is not liable in the event that a change in the date and/or location of the show is inevitable due to a national emergency, a natural disaster or other act of God. Article 7 Provision of Information on Organizer Exhibitors must provide data on exhibits and construction so that the organizer may determine whether the equipment and activities undertaken within the booth comply with the regulations. Exhibitors must also provide necessary information for public relations of Comic Con Seoul 2020. Article 8 Intellectual Property. Exhibitor should respect the intellectual property rights of other parties. Exhibitor shall not market, sell or display any product at the Exhibition that is counterfeit or in any way infringes trademarks, copyrights, patents or other intellectual property of a third party. Exhibitor warrants that the names, logos, art work and other content Exhibitor or its agents submitted for use in any media (including, but not limited to, ads, the Exhibition website or any Exhibition publication) shall not infringe the intellectual property rights of any third party and shall not contain anything which is libelous, obscene, indecent, blasphemous or in any way unlawful. Any exhibitor determined to be involved in unauthorized, counterfeit or infringing activity, will be subject to having all such unauthorized, infringing, counterfeit or misleading products removed from the Exhibition or the exhibitor being removed from current and future Exhibitions. However, this stipulation does not create an obligation for Management to take such action. Management does not accept liability for intellectual property infringements that may be committed by the Exhibitor. Article 9 Installation & Withdrawal Installation and withdrawal must be completed within the period stipulated by the organizer. Exhibitors must compensate the organizer for any loss or damage done due to any delay. Article 10 Insurance, Security and Safety 1. Exhibitors must have insurance for all equipment and exhibits during the installation, withdrawal, and exhibition period. The organizer will take appropriate measures to protect the rights of exhibitors and visitors. However, the ultimate liabilities of all items of the exhibitors reside with the exhibitors. 2. All materials such as stands and equipment must be incombustible according to fire safety acts. 3. The organizer may limit construction work and performance if needed. Article 11 Application & Interpretation of Related Regulation 1. When necessary, the organizer may enact a supplementary regulation not mentioned in this participation regulation. Exhibitors must comply with the supplementary regulation and that of Coex. 2. Matters not mentioned in this contract follow the related regulations and laws designated by the organizer. 3. In case of different interpretations between the organizer and exhibitors of the contract and other documents, those of the organizer must be followed. Article 12 Resolution of Disputes Dispute between exhibitors and the organizer will be arbitrated by the Korea Commercial Arbitration Board, and their resolution will be binding to both parties. Article 13 Clean Fulfillment of Contract Regarding this contract, the organizer and exhibitors must not directly/indirectly request or provide any sort of inappropriate granting such as bribable services and money. Both parties must mutually strive to maintain a clean and transparent trading environment and fair trade orders.
